APGA with Coalition of States and Trades Challenge Biden Administration’s Flawed Water Heater Rulemaking

 

Washington, D.C. (January 17, 2025) – The American Public Gas Association (APGA), representing more than 730 communities across the U.S. that own and operate their retail natural gas distribution entities, issued the following statement announcing its joint legal challenge of the U.S. Department of Energy’s (DOE) recently finalized rule revising its minimum efficiency standards for gas-fired instantaneous water heaters (GIWHs):

 

“APGA joined other trade associations, attorneys general, and one manufacturer in filing a legal challenge today of DOE’s final efficiency standards for gas-fired instantaneous water heaters.  APGA supports appliance efficiency standards that are cost-justified and preserve consumer choice.  Unfortunately, this is the most recent of several DOE rulemakings that fails to do so.”

 

“The final rule establishes efficiency standards for certain consumer water heaters at levels that will eliminate an efficient and affordable appliance option for American households.  Consumers should be able to choose the water heater that best fits their needs, budgets, and homes. This flexibility should be reflected in standards set for water heaters and all gas-fired appliances.”

 

“APGA thanks all involved in pushing back against this flawed rulemaking, including co-petitioners in this legal challenge, as well as members of the U.S. House of Representatives, led by Congressman Palmer, who introduced a Congressional Review Act resolution of disapproval for this same rule earlier this week.  This level of opposition from a wide range of interests demonstrates how impactful this rulemaking will be to consumers if it is not vacated.”
