APGA Thanks Stakeholders for Amici Briefs in Furnace Rule Case

 

Washington, D.C. (February 25, 2026)  Last month, the American Public Gas Association, American Gas Association, and National Propane Gas Association filed a petition asking the U.S. Supreme Court to consider a 2-1 decision from the U.S. Court of Appeals for the District of Columbia Circuit which sided with a Biden-era ruling blocking the sale of non-condensing natural gas furnaces and commercial water heaters. Non-condensing furnaces, which make up approximately 55 percent of the market for natural gas furnaces in the United States, cannot be replaced by other furnace types, and their removal from the market would saddle families with costly renovations or eliminate gas as a home heating option altogether. In response to recent amici briefs submitted by other stakeholders, APGA has issued the following statement.

APGA is grateful for the amici briefs recently filed in support of our joint challenge.  The broad and diverse interests of stakeholders who have weighed in underscore the significance of this case and the far-reaching impact of the issues before the court.  This also reflects a shared recognition that getting this right is critical not only for those directly affected by the flawed rules, such as appliance manufacturers, but also for the entire supply chain and broader public, especially American natural gas consumers.  APGA looks forward to the court’s review of these submissions and remains committed to ensuring that the issues presented are resolved in a manner that best serves the public interest.
