APGA Provides Feedback on How DOE Should Issue IRA Funding for Latest/Zero Energy Building Codes (April 26 2023)

On April 26, APGA submitted comments in response to the Department of Energy’s (DOE) request for information (RFI) pertaining to the potential funding opportunity announcement (FOA) for Technical Assistance for Latest and Zero Building Energy Codes Adoption.

The Inflation Reduction Act (IRA) appropriated $1 billion to help drive emissions reduction through the adoption of codes and standards.  Of the $1 billion allocated, Congress appropriated $330 million to support the adoption and implementation of the latest model energy codes (i.e., 2021 IECC & ASHRAE Standard 90.1-2019) and $670 million to support the adoption and implementation of zero energy building codes (e.g., zero energy provisions found in Appendices RC and CC or the 2021 IECC) or other codes or standards that achieve equivalent or greater energy savings.  The RFI is intended to collect feedback from stakeholders like APGA on considerations DOE should take into account ahead of issuing a potential FOA.

Through the comments, APGA urged DOE to maintain fuel neutrality in any FOA it issues.  To support fuel neutrality, the comment letter pointed to the important role that public gas utilities, and the natural gas industry more broadly, play in helping achieve decarbonization goals, as well as highlighting the recent 9th Circuit decision that overturned a gas ban ordinance in Berkeley, CA due to federal preemption.  The comment letter also offered pertinent metrics for DOE to take into consideration when distributing funds, as well as suggestions to ensure disadvantaged communities can best take advantage of any funding.
