On May 26, APGA submitted comments in response to the Federal Energy Regulatory Commission’s (FERC) notice of inquiry (NOI) regarding the certification of new interstate natural gas facilities. Through the comments, APGA reiterated many of the 2018 comments to the same docket – namely, that FERC should protect captive shippers in its policy – while also supporting many positions put forward by the American Gas Association (AGA).Through the NOI (Docket No. PL18-1), FERC sought “new information and additional stakeholder perspectives to help the Commission explore whether it should revise its approach under the currently effective policy statement on the certification of new natural gas transportation facilities to determine whether a proposed natural gas project is or will be required by the public convenience and necessity.” APGA, in support of AGA’s comments, asked FERC to only make mindful changes to the policy as it has been generally effective as implemented and needs to maintain that flexibility as the energy landscape continues to evolve. While public gas systems do not build interstate natural gas facilities regulated by FERC, APGA members do buy gas from pipelines set at rates approved by FERC.
