TSA to Host Additional Forum on Cybersecurity Rulemaking

On August 3, the Transportation Security Administration (TSA) will be hosting another (listening) forum for utilities/companies that have undergone their SD2 inspections. A proposed rule titled “Cybersecurity Risk Management, Strategy, Governance, and Incident Disclosure” was released in March of 2022, which will require only covered utilities/companies to abide by certain standards and enhancements to their reporting of cybersecurity incidents and their implementation of cybersecurity policies and procedures. It is important to note, though, that the SD2 rule currently only affects a small number of APGA members, and those that are affected have been preparing and engaging on the subject since the directive’s release. APGA staff monitor and engage in these conversations and events in order to stay abreast of potential changes that could perhaps affect additional APGA members and ensure that currently covered utilities are represented and have the proper information and resources when necessary. 

The forum will take place in Phoenix, Arizona at the Southwest Gas facilities and will provide utilities/companies with the space to ask questions and raise concerns about the SD2 inspections that have already occurred. APGA staff and APGA members have participated in two similar forums already. In the past sessions, TSA has engaged in open discussions with representatives from covered entities and followed up with responses and/or modifications after the meeting when concerns or questions were raised. These forums are a great opportunity for APGA members that are covered by this directive to engage and, in essence, to shape the final policy by sharing their lived experiences. The American Gas Association is also hosting a follow-up conversation the next day for operators to attend and discuss other ways that their experience could better benefit the TSA and forthcoming rules.
