APGA Submits Comments on PHMSA’s Proposed BABA Waiver

On August 28, APGA submitted comments in response to the Pipeline and Hazardous Materials Safety Administration’s (PHMSA) proposed Build America, Buy America (BABA) waiver for gas meter sets and some risers purchased for projects funded by the Natural Gas Distribution Infrastructure Safety & Modernization (NGDISM) grant program. 
 
PHMSA removed service regulators from this proposed BABA waiver due to a lack of information concerning anticipated demand. PHMSA asked for commenters to provide information concerning “the demand for service regulators purchased through the NGDISM program to inform its future consideration of any potential waivers of BABA requirements for service regulators.” APGA’s comments specifically attempted to address this request. APGA collected data from over 30 APGA member systems including Fiscal Year (FY) 2022 and 2023 grantees as well as those that applied in FY2024 and plan to apply in the future. PHMSA will now work with any company able to supply BABA compliant service regulators to determine if its production capacity can meet anticipated demand. And, PHMSA will review comments submitted on the proposed BABA waiver for meters and some risers to determine if they will proceed with a programmatic waiver. A formalized response from PHMSA is anticipated in the next few weeks.
