DC District Court Remands Commercial Packaged Boiler Rule to DOE

On January 19, the D.C. District Court of Appeals remanded the final Commercial Packaged Boiler Rule to the Department of Energy (DOE), outlining several areas for which DOE did not provide sufficient rationale to justify a more stringent appliance energy efficiency standard. DOE has 90 days to address the court’s concerns, else the rule be fully vacated.

APGA, Spire, and the Air-Conditioning, Heating, and Refrigeration Institute (AHRI) challenged the final rule after it was published in 2020. Oral arguments were held in September 2021.
